Diaz Ruano v. Holder, 10-1876

In a petition for review of a BIA order denying the application of petitioner, a Guatemalan citizen, for withholding of removal and protection under Article III of the United Nations Convention Against Torture (CAT), petition for review is denied where fear of persecution because of his membership in a social group composed of males sought out for information and recruitment by a criminal gang of Guatemala falls outside the purview of 8 U.S.C. section 1231(b)(3)(A).
