Berrios-Romero v. Estado Libre Asociado de PR, 10-1442
In a 42 U.S.C. section 1983 action by plaintiff-prisoner claiming that an administrative decision finding him ineligible under Puerto Rican law for pre-parole community-based diversion programs violated federal due process, judgment of the district court dismissing claim is affirmed because an intervening decision by the Puerto Rican Court of Appeals on the case, holding that plaintiff is not entitled to relief under Puerto Rican law, precludes action on the basis of res judicata.
