Ocasio-Hernandez v. Fortuno-Burset, 09-2207

In a dispute involving a claim of political discrimination stemming from the 2008 gubernatorial election in Puerto Rico, Rule 12(b)(6) dismissal by district court is reversed where, taking all well-pleaded factual allegations as true, the complaint sufficiently alleged knowledge of the political affiliation of the plaintiffs and that knowledge of such affiliation induced the termination of plaintiffs.
