US v. Anonymous Defendant, 10-1033
Following defendant's guilty plea for distributing and conspiring to distribute ecstasy and illicit gambling activities, district court's imposition of a 120-month imprisonment is affirmed where: 1) the authority to conduct review of whether the imposed sentence is reasonable, which in effect, resolves any question as to whether the extent of the departure is reasonable, is sufficient to confer appellate jurisdiction; 2) district court did not commit procedural error of any kind as the downward departure from the guideline sentencing range was within the discretion of the district court; and 3) defendant's sentence was sufficiently explained and fell within the universe of reasonable outcomes.
