In plaintiff's breach of oral contract claim against a defendant for failure to pay for an expert's expedited services in an underlying litigation, district court's judgment in favor of the plaintiff is affirmed where: 1) the jury instructions do not entitle defendant to judgment as a matter of law or a new trial; 2) district court did not abuse its discretion in awarding prejudgment interest as the requirements of the Massachusetts prejudgment interest statute have been satisfied; and 3) plaintiff's motion for sanctions on the basis that defendant's appeal is groundless and intentionally misleading is denied as, although defendant's appeal fails, it was neither frivolous nor an unreasonable or vexatious multiplication of proceedings.
