United States First Circuit
Concillo De Salud Integral De Loiza, Inc. v. Perez-Perdomo, 09-2067
In two Puerto Rican community health centers' request for an injunction requiring payment by Puerto Rico's Secretary of Health of Medicaid reimbursements that the two centers claimed to be due to them, district court's denial of the request is vacated and remanded as the court-ordered obligation continued throughout the "gap period" and the Secretary's Eleventh Amendment objection fails as to payments based upon the permanent injunctions.
