US v. Figueroa-Cartagena, 08-2110

Conviction of defendant for aiding and abetting a carjacking that resulted in death and other related crimes is affirmed in part, reversed in part and remanded where: 1) sufficient evidence supports defendant's carjacking conviction; 2) sufficient evidence supported defendant's conspiracy conviction; 3) there was insufficient evidence to support defendant's conviction on the firearm count as it was unreasonable for the jury to find defendant guilty in the absence of any proof that she knowingly facilitated the use or carriage of the firearm; and 4) defendant's evidentiary and procedural arguments in support of her request for a new trial are rejected.
