US v. McMullin, 07-2064

Conviction for drug crimes and firearms possession is affirmed where: 1) the district court did not err in denying defendant's motion to suppress as there was a substantial basis for concluding that probable cause existed to believe that defendant had contaminated his neighbor's well with Diazinon and that a fair probability existed that the pesticide would still be at defendant's property; and 2) the court did not abuse its discretion in denying defendant's motion to withdraw his guilty plea as the record clearly shows that defendant's plea was voluntary, intelligent, and knowing.
