Centennial Ins. Co. v. Patterson, 08-1521
In a dispute involving insurance coverage, district court's grant of summary judgment for defendant is affirmed where: 1) the claims against defendant can be construed as ones arising out of veterinary malpractice or negligence, which potentially fall within the coverage of the insurance policy and thus trigger plaintiff's duty to defend; and 2) plaintiff's duty to defend was not relieved by Exclusion H in the insurance policy.
