US v. Wyatt, 08-1539
Conviction for conspiracy to commit wire fraud is affirmed where: 1) plaintiff's claim for ineffective assistance of counsel cannot be sustained on direct appeal and instead must be remitted to a petition for collateral relief; 2) district court did not abuse its discretion by preliminarily ruling that character evidence to show defendant's intent, knowledge, and absence of mistake would be admissible; and 3) district court did not err in denying defendant's motion for acquittal as there was sufficient evidence to support the jury's finding of intent.
