In an action involving police officer's claims of race-based hiring determinations, district court's grant of summary judgment to defendants is affirmed where: 1) plaintiffs' claim that they are entitled to strict scrutiny of the alleged race-based employment actions taken by defendant fails as they failed to produce evidence that the governmental decisions here were based on race; and 2) defendant's actions were within the scope of its obligations under the Castro consent decree.
