United States First Circuit
Stewart v. Astrue, 08-1386
District court's order, directing the Commissioner of Social Security to reopen an application for disability benefits allegedly filed in 1988, was premature because there are legitimate questions as to whether the application was ever filed and, in turn, whether the district court has subject matter jurisdiction.
