In a claim involving state anti-discrimination statute, grant of motion for summary judgment and denial of two discovery motions in favor of defendant-employer are affirmed where: 1) plaintiff-former employee's arguments suggesting pretext were unconvincing; 2) defendant's decision to replace plaintiff with the better performing candidate as part of its reduction in force argument was a "clear, specific reason[]" for plaintiff's termination separate from any retaliatory animus; 3) the district court did not abuse its discretion in denying plaintiff's motion to compel; and 4) even if the documents plaintiff were to obtain through this additional discovery raised a material dispute concerning defendant's reduction in force rationale, the request was untimely.
