Linares v. US, 081548
In a claim brought under the Federal Tort Claims Act, order for dismissal and for sanctions is reversed and case is reinstated where: 1) the district court read the standing order too inflexibly; and 2) the district court acted outside the realm of its discretion in dismissing the action and imposing a monetary sanction without first affording the plaintiff notice and a brief opportunity to cure.
