Puerto Ricans for Puerto Rico Party v. Dalmau, 072700
In a suit alleging abuse and uneven application of certain electoral processes in Puerto Rico, dismissal is vacated, award of attorneys' fees is reversed, court records are ordered to be returned to Puerto Rico Supreme Court, and case is remanded where: 1) the district court erred in granting a motion to dismiss that turned entirely on an untranslated Spanish language decision of the Puerto Rico Supreme Court; 2) the Rooker-Feldman doctrine, which bars parties who lost in state court from "seeking review and rejection of that judgment" in federal court, did not apply; and 3) the case should not have been dismissed on res judicata grounds.
