US v. Beatty, 06-2481

Sentence for distribution of cocaine base is affirmed over claims of error that: 1) because defendant entered a timely guilty plea and because the government did not engage in any trial preparation, the government did not have any legitimate rationale for withholding the motion for a third-level reduction; and 2) defendant's sentence of 210 month, the low-end of the guideline range that applied in his case, is unreasonable.
