Ruiz-Rivera v. Pfizer Pharm., LLC., 07-1595
In a case against employer "regarded as" a disability claim for a violation of ADA, grant of summary judgment, on reconsideration, for employer is affirmed where: 1) plaintiff failed to meet the pleading requirements for employer's alleged violation of a statutory section as the complaint consists of nothing more than a solitary statutory reference with nothing to support it; and 2) reference to a statutory section was so fleeting and inadequate that there was nothing for the district court to review.
