United States First Circuit

US v. Rogers, 06-2532

Conviction and sentence for possession of child pornography is affirmed over claims that the district court: 1) erred in denying a motion to suppress evidence because the police exceeded the scope of their search warrant authorizing them to search for "photos of [a minor child]" when they seized and later viewed a videotape; and 2) should have ordered his entire federal sentence of imprisonment to run concurrently with his undischarged state sentence pursuant to section 5G1.3(b) of the federal sentencing guidelines.
