In a suit alleging age discrimination, summary judgment for defendant-employer is affirmed where: 1) insomuch as the District Court did not consider certain statements and assertions put forward by plaintiff in support of his objection to defendant's motion for summary judgment as constituting reliable evidence or a disputed material fact, there was no error; 2) plaintiff failed to present facts from which a reasonable jury could conclude that he was discharged; 3) plaintiff did not make out a case for constructive discharge; and 4) plaintiff did not show that defendant's acceptance of his resignation was pretextual.
