Indianapolis Life Ins. Co. v. Herman, 07-1797
In a suit alleging breach of a cross-claim plaintiff's employment contract and pension plan rights, breach of fiduciary duty under ERISA and conversion of property, an execution order against the personal assets of an ERISA trustee is affirmed where several of the claims set forth in plaintiff's complaint were sufficient to put the trustee on notice of the possibility of personal liability.
