Bourne v. Northwood Props., LLC, 07-1146
In a suit concerning a condominium developer's bankruptcy reorganization plan and development rights: 1) judgment of the district court concerning the developer's rights is reversed and remanded where the court's interpretation of the governing statute was in error; and 2) the bankruptcy court's affirmation of the reorganization plan is affirmed where there was no violation of the Statute of Frauds and the plaintiffs were not adversely affected by the plan.
