US ex rel. Rost v. Pfizer, Inc., 06-2627
In whistleblower action against defendant pharmaceutical company under the federal False Claims Act, dismissal for failing to meet the pleading requirements for allegations of fraud under Federal Rule of Civil Procedure 9(b) is affirmed as the complaint fails to meet the heightened pleading standard for FCA claims, but remanded so that the district court may consider plaintiff's request for leave to amend, which it did not address.
