United States First Circuit

Monfort-Rodriguez v. Rey-Hernandez, 06-1624

In a suit alleging unconstitutional demotion based on political affiliation, summary judgment for defendants is vacated where the admissible evidence and the plausible inferences that a jury could draw from it sufficed to meet plaintiffs' burden to show a genuine factual dispute as to whether an incoming director knew of their political affiliation and replaced them with his political allies based solely on that association.
