N. Am. Specialty Ins. Co. v. Seacoast Crane Co., 07-1497
In an indemnification suit brought by an insurer to recover monies paid out pursuant to a performance bond it issued on behalf of a construction company, summary judgment for plaintiff is affirmed where plaintiff's claim was not barred by the Maine Insurance Guaranty Association Act since defendants were not policyholders of a policy issued by an insolvent insurer, thus they were not covered by the Act's protections.
