Tum v. Gonzales, 06-1387
Petition for review of a denial of applications for asylum, withholding of removal, and protection under the Convention Against Torture is denied where: 1) the court lacks jurisdiction to review the BIA and IJ's determinations that petitioner's asylum application was not timely filed and that she did not qualify for an exception to the filing deadline; 2) petitioner did not show that she had suffered past persecution or was likely to suffer future persecution; and 3) petitioner did not show that it was more likely than not that she would be tortured upon return to her country of origin.
