United States First Circuit

Perez De Vega v. Gonzales, 06-1813

Petition for review of a determination of inadmissibility and a denial of cancellation of removal is denied where: 1) the purpose, duration, and nature of a legal permanent resident's departure from the U.S. are irrelevant to the legal determination of whether she must undergo the admission process upon her return; and 2) the evidence contained in the record clearly and convincingly supports the IJ's finding that petitioner was convicted of a crime amounting to an aggravated felony.
