Davila v. Corporacion de Puerto Rico para la Difusion Publica, 06-2353
In a suit alleging age discrimination against Puerto Rico's public broadcasting outlet, summary judgment for defendant is affirmed where: 1) there was no clear legal answer to plaintiff's due process argument raised on appeal, thus it cannot survive plain error review; and 2) there is nothing in the summary judgment record from which a reasonable factfinder could conclude that plaintiff was dismissed because of his age.
