Ruiz v. Holiday Universal, Inc., 06-2254

In a suit alleging that the terms of a health club membership contract violated Massachusetts consumer protection law, dismissal for failure to state a claim is affirmed where, while the plaintiff had standing to pursue the action, the contract did not violate the statutory provisions.
