United States First Circuit

Cordi-Allen v. Conlon, 06-2300

In a 42 U.S.C. section 1983 "class of one" suit by property owners alleging that a municipality denied them equal protection of the laws by obstructing their property development plans, summary judgment for defendants is affirmed where plaintiffs did not present probative evidence sufficient to create a genuine issue of material fact as to the existence of disparate treatment between them and other similarly situated persons.
