United States First Circuit

In a suit alleging violation of plaintiffs' First Amendment political affiliation and Fourteenth Amendment due process rights, a district court order finding that defendants had qualified immunity against the plaintiffs claims, but ordering the plainitiffs' reinstatement to their former positions, is affirmed where the defendants acted on the advice of the Secretary of Justice, as they were required to do by law, and the defendants' mere submission of a check for a filing fee to the district court clerk, without a notice of appeal or any other filing, was insufficient to notice an appeal.
