United States First Circuit
US v. Lino, 05-1665
Sentence for cocaine distribution and conspiracy is affirmed over defendant's arguments that: 1) the district court erred in ruling that a Massachusetts drug conviction was "a prior felony drug conviction" that triggered a sentencing enhancement; 2) the district court erred in declining to credit him with time he had already served on his undischarged sentence for the Massachusetts drug conviction; and 3) the sentence imposed was unreasonable because the district court failed to appreciate the advisory nature of the guidelines and did not consider whether to vary from the guidelines sentencing range to account for time already served.
