Ramallo Bros. Printing, Inc. v. El Dia, Inc., 06-2512
In a suit by a printing company alleging antitrust violations arising out of a newspaper group's policy that all supplements must be printed by a group-owned press, dismissal on grounds of collateral estoppel and res judicata is affirmed where: 1) there was no material distinction between the issues decided by the district court in a previous lawsuit between the parties and the issues plaintiff sought to have decided in the current lawsuit; 2) the changed circumstances alleged in plaintiff's second suit were legally insignificant and did not defeat collateral estoppel; and 3) every claim raised in this case was raised or could have been raised in the first case.
