United States First Circuit
US v. Rivera-Rodriguez, 04-1009
Sentence for conspiracy to possess controlled substances with the intent to distribute is affirmed over defendant's arguments that: 1) the district court erred by failing to give him notice that the court intended to rely on testimony from his co-defendants' trial in deciding where to sentence him within the guideline range; 2) the government breached its plea agreement with him; and 3) the court erred by imposing a two-level increase for his role in the offense as an organizer or leader.
