Bader v. Warden, NH State Prison, 05-2587
In a petition for a writ of habeas corpus, summary judgment against petitioner is affirmed where petitioner had not presented sufficient evidence to create a genuine issue of fact on his Brady claim, and the district judge did not err in denying further discovery after three disinterested witnesses had given testimony undermining petitioner's claim.
