Hoyos v. Telecorp Communications, Inc., 06-1178
In a suit alleging discrimination in plaintiff's termination and withholding of ERISA benefits, summary judgment for defendant-employer is affirmed where: 1) Puerto Rico Law 2 was a local procedural rule that cannot govern proceedings in federal court; 2) the district court correctly concluded that plaintiff had created no genuine issue of material fact as to whether the company had good cause for terminating his employment; and 3) plaintiff failed to rebut defendant's good cause and non-discriminatory reason for terminating his employment.
