United States First Circuit
Fontes v. Gonzales, 05-1755
Petition for review of a deportation order and the denial of petitioner's motion to reopen is denied over petitioner's arguments that: 1) the order of deportation is barred by res judicata and 2) the motion to reopen should have been allowed because petitioner is eligible for a waiver of deportability pursuant to former Immigration and Nationality Act section 212(c).
