Santa-Rosa v. Combo Records, 05-2237

Dismissal of singer's claims against a record company for rescission of his recording contract and for a declaratory judgment that he has an ownership interest in the recordings is affirmed where: 1) the rescission claim was preempted by the Copyright Act, thus the district court properly dismissed the case for failure to state a cause of action; and 2) the declaratory judgment action under the Copyright Act was barred by the statute of limitations.
