US v. Pelletier, 06-1287
Conviction and sentence for multiple parole violations are affirmed where: 1) the Supreme Court's decision in Hudson v. Michigan, 126 S. Ct. 2159 (2006) that a violation of the "knock and announce" rule in the course of executing a search warrant did not justify the suppression of evidence subsequently discovered applies with equal force in the context of an arrest warrant; 2) there was no clear error in the magistrate judge's determination that defendant's statements to police were voluntary; and 3) the sentencing judge correctly classified defendant as a career offender and the overall sentence was reasonable.
