Castaneda-Castillo v. Gonzales, 05-2384

The BIA's denial of applications for asylum and withholding of removal, based on a finding that petitioner had assisted or otherwise participated in the persecution of others in Peru on the basis of their political opinion, is reversed where substantial evidence does not support the BIA's determinations.
