Kandamar v. Gonzales, 05-2523
Petition for review of the dismissal of an appeal of a final order of removal is denied where: 1) the court has no jurisdiction over a denial of voluntary departure; 2) the lack of an adequate voluntary departure hearing does not violate due process, since voluntary departure is a privilege and not a right; 3) the National Security Entry - Exit Registration System did not violate equal protection rights; and 4) the seizure of petitioner's passport did not violate the Fourth Amendment since he could demonstrate no prejudice that would warrant reversal of the removal order.
