Silva v. Gonzales, 05-2736

Petition for review of denial of applications for asylum, withholding of removal, and protection under the Convention Against Torture (CAT) is denied where: 1) the court does not have jurisdiction to review determinations concerning timeliness; 2) petitioner did not exhaust his administrative remedies; and 3) the IJ's credibility determination was not erroneous.
