Charter Communications v. Burdulis, 05-1653
Award of damages in a suit by a cable company against two individuals who had engaged in the theft of cable programming is affirmed where: 1) the remedies for theft of radio communications under 47 U.S.C. section 605 do not apply to plaintiff; 2) the applicable remedies statute allows only one award not to exceed $10,000; and 3) the court did not err in refusing to award additional damages to further a deterrence policy.
