Petition for review of judgment of removability is denied in part and dismissed in part where: 1) the petitioner's conspiracy conviction qualified as a conviction for an aggravated felony; 2) the court lacks jurisdiction to entertain petitioner's fact-based challenge to the BIA's denial of his cross-application for withholding of removal; and 3) the BIA's denial of the petitioner's motion to reopen or remand was unassailable.
