Denial of motion to reopen proceedings and finding that petitioner was not entitled to discretionary relief are affirmed where: 1) petitioner did not preserve a challenge to a summary dismissal by filing a brief with the court; and 2) the court lacks jurisdiction to hear other claims since petitioner's due process rights were not violated and the BIA acted properly within its discretion on his motion to reopen.
