U.S. v. Ayala-Lopez, 06-1640

Denial of motion to strike the third notice of intent to seek the death penalty against the defendant is affirmed over defendant's arguments that: 1) the amended notice of intent to seek the death penalty was not provided "a reasonable time before trial"; 2) changes in the notice prejudiced him; 3) service of a notice of intent to seek the death penalty must be made on defendant personally; and 4) it was improper to allow amendment of the notice absent a "showing of good cause."
