United States First Circuit

U.S. v. Martinez, 04-1013

Conviction and sentence for possession and distribution of narcotics are affirmed where: 1) language in a Title III application was specific to the investigation and not boilerplate; 2) the government did not cast its investigation in overly broad terms to justify the wiretap; and 3) defendant could not establish a reasonable probability of a lesser sentence on remand.
