Perez-Cordero v. Wal-mart Puerto Rico, 05-1255

Summary judgment for defendant in a gender discrimination and retaliation suit is reversed and remanded for consideration of the opposition to summary judgment where ambiguous language in earlier orders created unfair surprise to plaintiff upon the district court's refusal to grant plaintiff an extension to the time allowed to file an opposition.
