PERRY v. FIRST CITIZENS FED. CREDIT UNION, 04-1286

A bankruptcy court's order, overruling plaintiff's objection to defendant-credit union's allegedly tardily filed proof of claim, is affirmed over plaintiff's argument that Section 726 of the Bankruptcy Code, which authorizes payment of tardily filed claims, is inapplicable since the source of the funds for payment in not "property of the estate."
