CITIBANK v. GRUPO CUPEY, INC., 03-1974

The district court did not err in allowing a third party to take the place of plaintiff-beneficiary of a surety bond, and it also was correct in subsequently dismissing the third party's complaint where the bond limited the defendant-surety's liability to the original named beneficiaries.
