CLAUDIO-GOTAY v. BECTON DICKINSON CARIBE, LTD., 03-1752
In a wrongful termination case, the Court found that defendant's actions were not retaliatory against plaintiff because plaintiff failed to file a complaint as required by the Fair Labor Standards Act. However, the Court reversed summary judgment for defendant on plaintiff's health care coverage claim, stating that whether plaintiff received adequate notice of his rights is a issue of fact that needs to be resolved.
